1. Use of the Site

You agree to use the Site only for lawful purposes and to provide accurate information when submitting forms. You may not misuse the Site, interfere with its operation, or attempt to access it in an unauthorized way.

2. Order Requests

• Online forms are requests only and do not guarantee an order. An order is confirmed only after we accept it and payment is received.
• Payment is taken by phone at (951) 677-4555 or in store.
• Lead times apply to certain products as posted on the Site. We may decline requests that fall inside those lead times or that we cannot fulfill.
• Prices, products, flavors, and availability shown on the Site may change without notice. Custom, special event, wedding, and dessert bar orders are priced by quote.
• Delivery is available for certain orders within our service area for the fees we quote or post.
• Deposits, cancellations, changes, and refunds are handled according to the terms we provide when your order is confirmed.

3. Dietary and Allergen Notice

Batter Up Bakery is not a gluten free facility. We offer gluten friendly options only and cannot guarantee any product is gluten free or free of any allergen. Our products may contain or come in contact with wheat, eggs, dairy, nuts, soy, and other allergens. Customers with food allergies or sensitivities should use their own judgment and contact us with any questions before ordering.

5. Intellectual Property

All content on the Site, including text, logos, photographs, and graphics, belongs to Batter Up Bakery or its licensors and is protected by law. You may not copy, reproduce, or use it without our written permission.

6. Customer Submissions

When you send us inspiration photos or design ideas, you confirm you have the right to share them and that our use of them to create your order does not violate anyone else's rights.

7. Disclaimer of Warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind regarding the Site, including that it will be uninterrupted or error free. Photos on the Site are examples, and finished products may vary.

8. Limitation of Liability

To the fullest extent permitted by law, Batter Up Bakery will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our text messaging program. Our total liability for any claim related to an order will not exceed the amount you paid for that order.

9. Indemnification

You agree to hold harmless Batter Up Bakery and its owners and employees from claims arising from your misuse of the Site or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Riverside County, California.
